These Mobile Messaging Terms (“Messaging Terms”) apply to the text message program operated by Behemoth Webstore Maciej Gruszka, Gdyńska 99, 80-297 Miszewo, Poland (“Behemoth Webstore”, “we”, “us”, “our”).

By subscribing to our text message program, you agree to these Messaging Terms. These Messaging Terms are supplemented by our Privacy Policy and our Terms of Service.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of information described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

1. Program Description

Our text message program delivers marketing and promotional messages relating to Behemoth Webstore, which may include:

  • Product releases and new collections
  • Restocks and product availability
  • Limited editions and collector releases
  • Promotions, discounts, and special campaigns
  • Events, collaborations, and brand news
  • Shopping cart and checkout reminders, where enabled and permitted by applicable law

Separately from the marketing program, we may send transactional or service messages relating to an order you have placed, such as delivery notifications. Transactional messages are not part of the marketing program and are not affected by unsubscribing from marketing messages.

You join the text message program by affirmatively agreeing to receive text messages at the telephone number you provide, for example by ticking a consent box on a signup form, at checkout, or on another Behemoth Webstore signup location where an appropriate consent disclosure is presented.

Consent to receive text messages is not a condition of any purchase. You may purchase products from Behemoth Webstore without subscribing to text messages.

Consent to text messages is separate from consent to email marketing. Subscribing to one channel does not subscribe you to the other.

Entering a telephone number for delivery or customer service purposes is not by itself consent to receive marketing text messages.

You represent that you are the subscriber of the telephone number you provide, or that you are authorized to provide that number and to consent on behalf of the subscriber. If you stop using a telephone number, or the number is reassigned, you agree to notify us so that we can update our records.

In certain countries we use a confirmed (double) opt-in process, which means your subscription becomes active only after you confirm it.

3. Eligibility

The text message program is intended only for individuals who are at least 16 years of age and who reside in a country where the program is available.

4. Country Availability

Our text message program is not available in every country. We are able to collect consent and deliver text messages only in a limited set of countries supported by our messaging service provider.

If your country is not supported, the subscription option may not be offered to you, or a subscription may not result in the delivery of messages. In that case you can continue to receive our communications by email.

The list of supported countries may change over time. You may contact us at support@behemoth-store.com to ask whether the program is currently available in your country.

5. Message Frequency, Costs, and Delivery

Message frequency varies and depends on our campaign schedule and on your activity in our store.

Message and data rates may apply. Any charges are billed by and payable to your mobile service provider in accordance with your mobile plan. We do not control and are not responsible for those charges.

Messages may be sent using automated technology.

Delivery of text messages depends on your mobile service provider and on network conditions. We are not liable for delayed or undelivered messages, and mobile carriers are not liable for delayed or undelivered messages.

Multimedia messages (MMS) are not available in all countries. Where MMS is not supported, messages are delivered as plain text.

6. How to Unsubscribe

You may unsubscribe from the text message program at any time. The available method depends on the type of sending number used for a given message:

  • Where two-way messaging is supported, reply STOP to any message from the program.
  • Where messages are sent using a branded sender ID or another sending method that does not accept incoming replies, use the unsubscribe link included in the message.
  • In all cases, you may contact us at support@behemoth-store.com and ask to be unsubscribed.

After you unsubscribe, we may send one final message confirming that your subscription has ended.

We retain a minimal suppression record of your unsubscribe so that we do not resume sending marketing messages to you without a new subscription.

Unsubscribing from marketing text messages does not stop transactional or service messages relating to an order you have placed, and does not unsubscribe you from email marketing. To unsubscribe from email marketing, use the unsubscribe link in a marketing email.

7. Help and Support

Where two-way messaging is supported, reply HELP to any message from the program for assistance.

You can always contact us at support@behemoth-store.com with any question about the program.

8. Privacy

Information collected in connection with the text message program is processed as described in our Privacy Policy, including the sections on email and SMS marketing.

We do not sell or rent your mobile telephone number, opt-in data, or consent information.

We disclose information relating to the program only to service providers that process it on our behalf solely to operate, deliver, secure, or support the program, which may include our messaging platform, our ecommerce platform, telecommunications carriers, messaging aggregators, cloud service providers, technical support providers, and fraud-prevention providers. We may also disclose information where required by applicable law or a valid legal request.

You may withdraw your consent at any time as described in section 6. Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

9. Changes to These Messaging Terms

We may update these Messaging Terms from time to time. We will publish the revised version on this page and update the “Last updated” date. Where required by applicable law, we will provide additional notice or request renewed consent.

10. Applicable Law

These Messaging Terms are governed by Polish law. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, which continue to apply.

U.S. orders — no surprises

To make shopping easier and fully transparent, U.S. orders are shipped via USPS in Delivered Duty Paid (DDP) mode. All import duties, taxes, and clearance costs are included at checkout.

This means:

  • No extra fees on delivery — USPS will not collect any money from you.
  • The total you see at checkout is the final total.
  • Faster, smoother delivery with no paperwork or surprises at your door.
  • Apparel and other merch: applicable duties are calculated and collected at checkout.
  • Coffee / tea: shipped without any additional FDA or import fees. Everything is included in the checkout total.

In short: what you pay at checkout is exactly what you pay — nothing more.

Heads-up for UK customers

We charge UK VAT at checkout on all orders (VAT no.: GB369523368).

  • Orders ≤ £135: Duty-free and nothing to pay on delivery — UK VAT is already collected at checkout.
  • Orders > £135: the carrier may collect import VAT and any applicable customs duties on delivery. If that happens, contact us — we’ll refund the UK VAT paid at checkout (proof of carrier charges may be required).
  • Media only (stickers, wall prints, posters, vinyl records, audio CDs): typically 0% customs duty (UK VAT still applies).
  • Mixed orders (e.g., vinyl/CD + apparel/other merch): non-media items may incur duty; the carrier may charge a clearance/disbursement fee.
  • Food / coffee / tea & supplements: standard import; expect UK VAT and possible carrier clearance/inspection fees (not charged at checkout by us).

Important notice for Canadian customers

We ship to Canada under DAP (Delivered At Place) terms — import duties, GST/HST and carrier brokerage fees are not included in your checkout total and will be collected by Canada Border Services Agency (CBSA) or your carrier upon delivery.

Canada's duty-free de minimis threshold is CAD $20 — almost all orders will be subject to duties and taxes.

Note on shipping method: Orders sent via UPS Express Saver will always go through full customs clearance — duties and brokerage fees apply. Orders sent via Canada Post (postal service) sometimes pass through without duty collection on smaller packages, though this is not guaranteed — duties are legally owed regardless of whether the carrier collects them.

  • Cotton T-shirts: duty approx. 18%
  • Cotton hoodies / sweatshirts: duty approx. 18%
  • Vinyl records: duty 0%
  • Audio CDs: duty 0%
  • GST/HST: 5–15% depending on your province, applied on CIF value (cost + insurance + freight) + applicable duty
  • Your carrier (DHL, UPS, Canada Post) may charge an additional brokerage or disbursement fee for advancing customs payments on your behalf.

Final amounts depend on the product's HTS classification, materials and carrier procedures. The values above are for guidance only.

Note: Orders shipped via standard postal service (Canada Post) are sometimes delivered without duties being collected — however, this cannot be guaranteed and depends on CBSA's discretion. Courier shipments (DHL, UPS) are more likely to have duties collected on delivery.

If import fees are not paid:

  • The parcel may be returned to us at your cost or held by CBSA.
  • For returns, your refund will be reduced by all return shipping and handling costs charged to us.
  • If the parcel is destroyed by customs, no refund will be issued.
